In A 2017 Sexual Harassment Case, A Mumbai Court Acquitted TVF Founder Arunabh Kumar.

Arunabh Kumar, the ex-CEO of web comedy channel The Viral Fever, was acquitted by a Mumbai court on Wednesday after being charged with sexual misconduct in 2017. The court ruled that there was a ‘unexplained and unreasonable’ delay in filing the First Information Report (FIR) in the matter, according to news agency PTI.

According to the prosecution, the alleged incident occurred in 2014. When the complainant discovered other women making similar allegations on social media three years after the incident, she filed a complaint. The woman had posted anonymously on medium.com under the title ‘The Indian Uber- That is TVF,’ alleging that the online content company’s founder had molested her during her time there.

Based on the former employee’s complaint, the Andheri police department filed a case against Arunabh Kumar in 2017 under Indian Penal Code Sections 354 A (causing sexual harassment) and 509. (word, gesture or act intended to insult the modesty of a woman).

A I Shaikh, Metropolitan Magistrate (Andheri court), acquitted Kumar in September of this year. “There is no concrete evidence produced by the prosecution,” the magistrate stated in his order. “There is a material disparity and contradiction. “There is even an unreasonable and unexplained delay in filing the FIR, casting doubt on the prosecution’s case,” the court stated.

According to the court, the complaint can even be said to be “filed out of grudge or rivalry on the basis of business” between the accused and the informant. “Interest witnesses” are all witnesses. They are both involved in the same industry in which the accused is also involved. As a result, the prosecution failed to prove its case beyond a reasonable doubt, according to the magistrate.
